TERMS AND CONDITIONS OF SALE
1. Parties and Role
Fusion Transports Inc. (“Company,” “We,” “Us”) acts as a licensed transportation broker and/or transport management provider, connecting Shippers/Customers (“Customer,” “You”) with qualified carriers or providing arranged transport solutions. The Company is not a motor carrier unless explicitly stated and does not physically transport vehicles. When services are fulfilled by a third-party carrier, that carrier is solely responsible for possession, control, and transportation of the vehicle.
2. Quotes and Pricing
- Quotes are based on current fuel, route, market conditions, and availability.

Pricing may change due to:
- Vehicle modifications (lifted, oversized, inoperable, etc.)
- Changes in pickup or delivery locations
- Delays caused by the Customer
- Market fluctuations
- Any price change must be agreed upon before dispatch.
- All prices are in U.S. Dollars.
3. Booking and Payment Terms
A booking may require a deposit or full payment depending on service type. Any remaining balance (if applicable) is due as specified on your order.
3.1 Accepted Payment Methods

3.2 Payment Conditions
- Failure to pay may result in the vehicle not being released or delivery being delayed.
- Returned or invalid payments may result in additional fees.
- Customer is responsible for any bank or transaction fees.
4. Scheduling, Pickup, and Delivery
- Pickup and delivery dates are estimated and not guaranteed.
- Factors such as traffic, weather, mechanical issues, DOT inspections, and road conditions may affect timing.
- Customer or an authorized representative must be present at pickup and delivery unless approved otherwise.
- A working key must be provided. Vehicle must be operable unless declared in advance.
5. Vehicle Condition Requirements
Customer agrees that the vehicle must:
- Roll, brake, and steer unless declared inoperable
- Have no excessive leaks or loose parts
- Be legally owned by the Customer, or the Customer must have authority to transport it
5.1 Personal Belongings
- Personal belongings are transported at the owner’s risk.
- Carriers are not responsible for damage or loss of personal contents.
- Excess weight may result in additional charges or refusal of transport.
6. Inspection and Bill of Lading
A condition inspection is completed at pickup and delivery. Any damage claims must:
- Be noted on the Bill of Lading at delivery
- Include photos
- Be signed by both the driver and the Customer
Failure to note damages at delivery may waive future claims.
7. Insurance and Liability
Carriers must maintain active Motor Carrier Cargo insurance.
7.1 Typically Covered
- Physical damage while under carrier custody
7.2 Not Covered
- Pre-existing damage
- Mechanical failures
- Undercarriage or hidden damage
- Acts of God (storms, hail, natural disasters)
- Glass damage or stone chips from roadway debris
- Personal belongings
Carrier insurance is the primary coverage. The Company assists customers with claims but is not responsible for insurance outcomes or payments.
8. Customer Responsibilities
Customer agrees to:
- Provide accurate vehicle information
- Provide correct pickup and delivery addresses
- Ensure someone is available for pickup/delivery
- Remove toll devices and disable alarms
- Provide proper payment as agreed
Failure to meet responsibilities may result in fees, delays, or cancellation.
9. Cancellations and Refunds
- Cancellations before dispatch may be refundable depending on service terms.
- Cancellations after dispatch may be subject to cancellation fees or carrier compensation.
- Non-refundable booking fees may apply.
10. Storage and Additional Fees
Customer is responsible for:
- Storage fees if delivery cannot be completed
- Redelivery fees if receiver is unavailable
- Tow or winch fees for inoperable vehicles
- Access or urban area restriction fees where applicable
11. Damage Claims Process
If damage occurs:
- Note damages on the delivery Bill of Lading
- Take photos at delivery
- Obtain driver signature
- Notify Fusion Transports within 24–48 hours
- File claim directly with carrier insurance
Claims cannot be processed without documentation.
12. Delays and Force Majeure
Fusion Transports is not responsible for delays caused by:
- Traffic
- Mechanical breakdowns
- Weather or natural disasters
- Law enforcement inspections
- Acts of God
Refunds will not be issued for delays outside reasonable control.

14. Indemnification
Customer agrees to indemnify and hold harmless Fusion Transports Inc., its employees, partners, and affiliates from any claims, damages, or expenses arising from:
- Incorrect or false information provided
- Illegal contents inside vehicle
- Undisclosed vehicle condition issues
15. Governing Law and Dispute Resolution
This agreement is governed by the laws of the State of Florida.
Disputes shall be handled through mediation or arbitration when applicable, before court litigation unless prohibited by law.
16. Entire Agreement
These Terms constitute the full agreement and supersede any verbal statements or prior agreements. No verbal modifications are valid unless confirmed in writing.
17. Acceptance
By booking, paying, or allowing the vehicle to be transported, the Customer acknowledges and agrees to these Terms & Conditions.
